T-Mobile Facing Class Action Lawsuit for Price Hike

If T-Mobile thought customers would quietly accept the recent price increase, they were mistaken. A group of customers is taking legal action against the company for not honoring its promise to never raise prices on certain legacy plans.

In May, T-Mobile raised prices on some plans by up to $5, catching customers off guard as these plans were supposed to be protected by the Price Lock and Un-Contract Promise. The FCC and FTC have received numerous complaints from disgruntled customers.

Despite a recommendation from the National Advertising Division (NAD) to halt advertising the “Price Lock” policy, no significant action has been taken against the company yet. Customers are adamant that they will not be satisfied until T-Mobile is held accountable for its actions. A group of customers who are unhappy about the carrier changing terms that were initially indicated to be permanent have filed a class action lawsuit against it.

The lawsuit aims to represent affected consumers in Georgia, Nevada, Pennsylvania, and New Jersey who were on specific T-Mobile plans covered by the Un-Contract guarantee in 2017. These include ONE, Simple Choice plan, Magenta, Magenta Max, Magenta 55 +, Magenta Amplified, or Magenta Military plan.

In 2020, as part of the Sprint merger approval process, T-Mobile committed to not raising prices on its plans for three years. The class action suit alleges that this merger led to reduced choices for consumers.

The plaintiffs accuse T-Mobile of common law fraud, false advertising, negligent misrepresentation, and violations of various laws such as New Jersey’s Consumer Fraud Act and Pennsylvania’s Unfair Trade Practices and Consumer Protection Law. They are seeking a jury trial along with injunctive relief and compensation for all class members.
