Phones Canada Auction Policy

1. Introduction

Welcome to Phones Canada’s Auction Services. By participating in our auctions, you agree to comply with this Auction Policy, which outlines the terms and conditions governing your participation.


2. Eligibility and Registration

  • Business Requirement: Participation is limited to registered businesses.

  • Resale Certificate: A valid resale certificate must be provided upon request.

  • Approval: Eligibility to participate is subject to Phones Canada’s approval.

3. Auction Participation

  • Binding Bids: All bids placed are binding. Once a bid is accepted, you are obligated to complete the purchase.

  • Auction Cancellation: Phones Canada reserves the right to cancel any auction at its discretion.

  • Proxy Bidding: Our system offers proxy bidding, allowing automatic bids on your behalf up to your maximum bid amount.

4. Fees and Payments

  • Service Fee: A 3% service fee is applied to the total winning bid amount for each auction.

  • Data Clearing Fee: An optional data clearing service is available at $1 per unit.

  • Wire Payment Fee: A flat fee of $25 is charged for payments made via wire transfer.

  • Payment Deadline: Payments must be completed within 24 hours of auction close.

  • Non-Payment Consequences: Failure to pay may result in forfeiture of the lot and account suspension.

5. Currency

  • Auction Currency: All auctions are conducted in USD with no option to change the currency.

6. Device Condition and Unlocking

  • As-Is Sales: All items are sold “as-is” without any warranties, express or implied.

  • Carrier-Owned Devices: Devices sold by their original carrier will come unlocked or can be unlocked upon request at no additional cost. To unlock devices, submit the IMEI on our unlocking page: Unlocking Service.

  • Other Carrier Devices: Devices from other carriers may come locked; unlocking is the buyer’s responsibility.

7. Data Clearing Requirements

  • Customer Information Removal: You must remove all customer information from purchased devices before resale.

  • Compliance Certification: Upon request, provide certification of compliance with data clearing requirements.


8. Export Restrictions

  • Geographical Limitations: Resale of merchandise is limited to authorized regions.

  • Trademark Removal: If reselling outside authorized regions, you must remove all branding and trademarks from the merchandise.

9. Dispute Resolution

  • Arbitration: Disputes related to auctions are handled through arbitration conducted by our team in coordination with the auction house and seller.

10. Governing Law

This Auction Policy is governed by the laws of Ontario, Canada.


11. Amendments

Phones Canada reserves the right to amend this Auction Policy at any time. Changes will be communicated via our website.


12. Buyer Responsibilities

  • Legal Compliance: Buyers are responsible for ensuring compliance with all applicable laws and regulations regarding the resale of purchased goods.
