2. Definitions

• “Services”: Refers to both inventory sales and auction services provided by Phones Canada.
• “User” or “You”: Any individual or business accessing our Services.
• “Inventory Sales”: Direct purchase of products listed on our platform.
• “Auction Services”: Bidding on products through our auction platform.
  
  

3. Eligibility and Registration

• Business Requirement: Services are available to registered businesses only.
• Resale Certificate: A valid resale certificate must be provided upon request.
• Account Information: Ensure all registration details are accurate and up-to-date.
  
  

4. Inventory Sales

• Product Listings:
  • Accuracy: We strive to provide accurate product descriptions. However, we do not warrant that descriptions are error-free.
  • Availability: Product availability is subject to change without notice.
• Pricing and Payments:
  • Currency: USD is listed as the default currency on inventory purchases. Buyers have the option to change it to CAD on the cart or checkout page. All auctions are conducted in USD with no option to change the currency.
  • Payment Methods: We accept Wire Payments and eTransfer via Interac Only.
  • Wire Payment Fee: A flat fee of $25 is charged for payments made via wire transfer.
• Shipping and Delivery:
  • Shipping Costs: Calculated at checkout based on destination and weight.
  • Delivery Timeframe: Estimated delivery times are provided but not guaranteed.
• Returns and Refunds:
  • Return Policy: Returns are accepted within 5 days of delivery, provided items are in original condition. Restocking fees are based on order or model and current market prices. Phones Canada reserves the right to apply restocking fees at its discretion, with no option for rebuttal. Shipping costs for returns are the responsibility of the buyer.
  • Refund Processing: Refunds will be processed within 5 days of receiving the returned item.
    
    

5. Auction Services

• Bidding Process:
  • Binding Bids: All bids placed are binding.
  • Proxy Bidding: Proxy bidding allows our system to automatically bid on your behalf up to your maximum bid amount. This ensures competitive participation without requiring real-time monitoring from the user.
• Fees:
  • Service Fee: A 3% service fee is applied to the total winning bid amount for each auction.
  • Data Clearing Fee: If you choose our data clearing service, a fee of $1 per unit will be charged.
• Payment Terms:
  • Payment Deadline: Payments must be completed within 24 hours of auction close.
  • Non-Payment Consequences: Failure to pay may result in forfeiture of the lot and account suspension.
• Device Unlocking:
  • Inventory Devices: Inventory displays whether devices are locked or unlocked.
  • Carrier-Owned Devices: Devices sold by their original carrier will come unlocked or can be unlocked upon request at no additional cost. To unlock devices, submit the IMEI on our unlocking page: Unlocking Service.
  • Other Carrier Devices: Devices from other carriers may come locked; unlocking is the buyer’s responsibility.
    
    

6. General Terms

• As-Is Sales: All items are sold “as-is” without any warranties, express or implied.
• Limitation of Liability: Our liability is limited to the amount paid for the specific product or auction lot in question.
• Dispute Resolution: Disputes related to auctions are handled through arbitration conducted by our team in coordination with the auction house and seller. For inventory sales, claims must be filed through our claims process.
• Governing Law: These Terms and Conditions are governed by the laws of Ontario, Canada.
• Amendments: We reserve the right to amend these Terms and Conditions at any time. Changes will be communicated via our website.
• Buyer Responsibilities: Buyers are responsible for ensuring compliance with all applicable laws and regulations regarding the resale of purchased goods.
  
  

By making a purchase from Phones Canada, the Buyer agrees to accept and be bound by the terms and conditions of this Agreement.

ALL CLIENTS AGREE TO BIND BY TERMS AND CONDITIONS OF THIS AGREEMENT.
