Apple Slapped with $2.7 Billion Fine by EU After Spotify’s Anti-Trust Complaint • Phones Canada News

The European Union (EU) has recently fined Apple a hefty €1.84 billion (approximately $2.7 billion CAD) following ongoing anti-trust complaints from Spotify. This marks the first time Apple has been required to pay such a fine to the EU, highlighting the significance of the issue.

According to the EU Commission, Apple’s App Store policies have been found to violate regulatory standards by restricting music streaming app developers from fully informing iOS users about alternative and potentially more affordable subscription services available outside of the app. This includes providing instructions on how to subscribe to these external offers and displaying their prices within the app.

Apple has been deemed to be in breach of Article 102(a) of the Treaty on the Functioning of the European Union (TFEU) for imposing these restrictions on third-party music apps. The EU Commission took into account various factors such as the duration and gravity of the infringement, Apple’s total turnover, market capitalization, and any misleading information provided by Apple during the investigation.

Spotify initially raised concerns about Apple’s App Store policies nearly five years ago, particularly objecting to the 30 percent commission charged by Apple and limitations on offering competitive deals within its ecosystem. In response to the EU’s decision, Apple issued a press release emphasizing that there was no credible evidence of consumer harm and defending its position in a thriving and competitive market.

Looking ahead, Apple will need to comply with the new Digital Markets Act (DMA) in the EU, allowing third-party app marketplaces on its devices but implementing a 17 percent commission for developers using their own payment methods along with additional fees per app installed after a certain threshold. Meanwhile, in the U.S., Apple is facing similar legal challenges from Epic Games over App Store policies that are perceived as anticompetitive.

This ongoing situation underscores the importance of fair competition in digital markets and highlights the complexities surrounding app store regulations both in Europe and globally.
