Terms of Service

LAST UPDATED · September 2026

Important Notice

By using Phones Canada services you agree to these terms. Please read them carefully: they contain important information about your rights and obligations, including limitations of liability and how disputes are resolved.

What We Provide

Phones Canada sources graded mobile devices from North American carrier auction channels and supplies them to verified wholesale buyers, handling shipping, customs documentation and delivery worldwide.

  • Device sourcing from verified North American carriers and auction channels.
  • Shipping and logistics coordination, domestic and international.
  • Customs documentation and processing assistance.
  • Account and order support.

What we are not

  • We are not a device manufacturer or authorised dealer.
  • We do not provide manufacturer warranties or technical support.
  • We are not responsible for device compatibility with local networks.
  • We do not handle manufacturer warranty claims or device repairs.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Verification

Access to wholesale pricing, auctions and services is limited to verified business buyers. We may request documentation before granting or maintaining access.

Buyer Responsibilities

Before ordering

  • Verify device compatibility with your local carriers and networks.
  • Understand any carrier unlock requirements or restrictions.
  • Review grade descriptions and manifests carefully.
  • Confirm you can receive international shipments at your address.
  • Understand local customs rules and potential fees.

Accurate information

  • Provide accurate contact and shipping details.
  • Keep a valid email address on file for order communication.
  • Tell us immediately about address or contact changes.
  • Respond promptly to verification requests.

Prohibited use

  • Providing false information or fraudulent payment details.
  • Attempting to bypass our ordering or verification processes.
  • Using our services for any illegal activity.

Order Terms

  • Orders are subject to availability verification; we may cancel if stock becomes unavailable.
  • Payment is required before processing begins.
  • Changes or cancellations must be requested within 24 hours of ordering.
  • Auction bids are placed on the auction house's platform on your behalf, are binding, and cannot be cancelled once placed.
  • Auction invoices are due within 2 business days of lot close. Non-payment ends your access to the platform and the bidding deposit is forfeited toward restocking and processing costs.
  • All sales are final unless a purchase meets our limited claim criteria.

Pricing & Payment

All pricing is in USD unless stated otherwise and is subject to change without notice. Import duties and taxes in the destination country are the buyer's responsibility.

Payment must be made through the methods set out in our Payment Policy. Bank charges and currency conversion losses are the payer's responsibility.

Delivery Terms

  • Delivery timeframes are estimates, not guarantees.
  • Delays caused by customs, weather or carrier issues are outside our control.
  • Signature confirmation is available and recommended on higher-value shipments.
  • Failed delivery attempts may result in return to sender at the buyer's cost.

As-Is Sales & Limited Claims

All devices are sold as-is with no manufacturer or implied warranties. Auction-sourced stock carries an inherent fallout rate of roughly 5%.

We accept limited claims for wrong model shipped, significant grading discrepancy, dead on arrival and shipping damage, within the windows set out in our Returns and Warranty policies.

Limitation of Liability

Phones Canada's liability for any claim relating to a purchase is limited to the amount paid for that purchase. We are not liable for indirect, incidental or consequential damages including lost profits, data loss or business interruption. Some jurisdictions do not allow these limitations.

Dispute Resolution

  • Step 1 — direct contact: email info@phonescanada.com with your order number, evidence and a description. We respond within 24–48 hours and aim to resolve within 14 business days.
  • Step 2 — mediation: if unresolved after 14 business days, both parties attempt mediation through the ADR Institute of Canada or a mutually agreed mediator, to be completed within 30 days, with costs shared equally unless otherwise agreed.
  • Step 3 — legal action: only after direct contact and mediation have been exhausted.

Privacy

By using our services you agree to the collection and use of information as set out in our Privacy Policy.

Changes To These Terms

We may update these terms to reflect changes in our services, legal requirements or business practices. Significant changes are communicated by email or a notice on this site.

Continued use of our services after an update constitutes acceptance of the revised terms.

Governing Law
