The recent Tim Hortons ‘Roll Up the Rim’ contest has stirred up quite a controversy, with the company now facing a potential class action lawsuit. Tim Hortons had informed numerous Canadians that they had won a boat and trailer worth up to $64,000, only to later retract the message, citing human error.

Now, LPC Avocats has filed an application for a class action lawsuit with the Superior Court of Quebec on April 19. It has been revealed that Tim Hortons mistakenly sent out winner emails to approximately 500,000 Canadians.

According to the class action filing, the email declared that recipients had won a Tracker Targa 18 WT 2024 boat and its trailer as part of the ‘Roll Up To Win’ campaign. The lawsuit alleges that this misleading information constituted a prohibited practice under Canadian law.

In response to the lawsuit, Tim Hortons told CTV News that they believe the class action has “no merit” and they are prepared to address the matter in court. The company acknowledged a human error in sending out incorrect information to some participants but promptly rectified it by issuing an apology.

The goal of the class action is to secure the boat prize for each member along with punitive damages of $10,000 per class member. The lawsuit argues that under the Consumer Protection Act, statements made by merchants like Tim Hortons are binding and must be upheld.
